Tails of the AfterGlow is a unique collection of 7,777 dope digital fox artworks (NFTs) roaming on the Polygon blockchain network. By signing the smart contract, the holder agrees to the terms and conditions contained herein and is solely responsible for the safety and management of their private Polygon wallets and assets. Holders also accept complete responsibility for any and all transactions involving Tails of the AfterGlow digital collectibles such as transferring, exchanging, selling, etc. Moreover, validation and approval of all transactions and contracts generated by this website are under the holder's authority. However, the holder cannot undo, reverse, or restore any transactions since the smart contract runs within the Polygon Network.
I. Holder has the complete ownership and rights of the TAG NFT (i.e. the art and the benefits) upon purchase. Ownership of the NFT is solely mediated by the Smart Contract and the Polygon Network: at no point may we seize, freeze, or otherwise modify the ownership of any TAG. However, should there be fraudulent activities within the holder's wallet, Real Deal Guild is not liable for any loss of assets.
II. Personal Use. Subject to continued compliance with these Terms, Real Deal Guild reserves all rights of the following to our TAG holders: worldwide, royalty-free license to use, copy, and display the purchased Art, along with any extensions that the holder choose to create or use, solely forth following purposes: (1) for personal, non-commercial use; (2) as part of a marketplace that permits the purchase and sale of your TAG, provided that the marketplace cryptographically verifies each TAG owner’s rights to display the Art for their TAG to ensure that only the actual owner can display the Art; or (3) as part of a third-party website or application that permits the inclusion, involvement, or participation of your TAG, provided that the website/application cryptographically verifies each TAG owner’s rights to display the Art for their TAG NFT to ensure that only the actual owner can display the Art, and provided that the Art is no longer visible once the owner of the TAG leaves the website/application.
III. Commercial Use. Subject to your continued compliance with these Terms, Real Deal Guild grants you an unlimited, worldwide license to use, copy, reproduce, modify, distribute, display, create derivative works of, or transmit any content based upon the Art (“Commercial Use”). Examples of such Commercial Use would be, e.g. the use of the Art to produce and sell merchandise (T-Shirts, shoes, bags, etc.) displaying copies of the Art. For the avoidance of doubt and/or confusion, the holder is completely unrestricted from (1) owning or operating a marketplace that permits the use and sale of TAG generally, provided that the marketplace cryptographically verified each TAG owner’s rights to display the Art for their TAG to ensure that only the actual owner can display the Art; (2) owning or operating a third-party website or application that permits the inclusion, involvement, or participation of TAG generally, provided that the third-party website or application cryptographically verifies each TAG owner’s rights to display the Art for their TAG to ensure that only the actual owner can display the Art, and provided that the Art is no longer visible once the owner of the purchased TAG leaves the website/application; or (3) earning revenue from any of the preceding.
